TERMS & CONDITIONS
The present “General Conditions of Sale” of LUXURYOFHOMES.COM (hereinafter, “Luxuryofhomes.com” and/or the “Site”) constitute a legally binding agreement between the user who navigates, accesses and/or uses the Site, also defined as the “Customer”, and Luxury of Homes Srl (hereinafter also the “Seller”). By accessing the Site and/or placing any order through the e-commerce services made available on the Site, the Customer acknowledges that they have read, understood and accepted these General Conditions in full.
These General Conditions regulate, and constitute an integral and essential part of, any quotation, offer, confirmation, acceptance, order, and agreement for the sale of goods stipulated between the Customer and the Seller, and shall prevail over any other agreement, condition, or term that may have been stipulated between the Parties unless expressly agreed in writing by the Seller.
GENERAL CONDITIONS
1.1 Luxury of Homes Srl enables Users to purchase goods (hereinafter, the “Goods” and/or “Products”) on the Website pages. Any purchase on the Website is available exclusively to Customers who satisfy all of the following requirements:
a) any natural person of age 18 or older, or any legal person duly and lawfully represented;
b) having read and accepted these General Conditions before submitting a purchase order;
c) not placing false, fraudulent, unlawful, or abusive orders.
1.2 Luxury of Homes reserves the right to cancel orders, suspend accounts, restrict access to the Site, refuse future transactions, and notify competent authorities where fraudulent or abusive conduct is suspected.
1.3 Amendments to these Conditions become effective upon publication on the Site.
1.4 The applicable Conditions are those in force at the time of submission of the Purchase Order.
1.5 Customers refusing amendments must refrain from using the Site.
1.6 Customers must provide accurate, complete and lawful information and agree to indemnify and hold harmless the Seller from any damage, claim, cost or liability arising from incorrect or unlawful data.
1.7 The Seller delivers worldwide. Delivery feasibility is confirmed in the Order Confirmation.
INFORMATION ON PRODUCTS
2.1 Products are manufactured by third-party Producers. Brand ownership remains with respective Producers.
2.2 Contractual elements include product description, specifications, pricing, availability, delivery terms, and payment method.
2.3 Product information and imagery are provided by Producers. The Seller shall not be liable for discrepancies attributable to such sources, without prejudice to mandatory consumer rights.
2.4 Prices are expressed in Euro inclusive of VAT unless otherwise specified. Shipping costs are calculated separately. Additional logistics costs not calculable at checkout may be requested and may result in cancellation and refund if not accepted.
2.5 Prices exclude import duties, customs fees, or local taxes imposed in destination jurisdictions, which remain the Customer’s responsibility.
2.6 Availability may change without notice.
PURCHASE PROCEDURE
3.1 Site content constitutes an invitation to treat. Contracts form only upon Seller acceptance.
3.2 Orders submitted through checkout constitute binding purchase proposals.
3.3 Acceptance occurs only after payment verification and availability confirmation.
3.4 Payment methods include credit card and bank transfer.
3.5 Unpaid orders may be cancelled after fifteen (15) days.
3.6 Pricing errors entitle the Seller to cancel or correct orders.
3.7 The Seller may refuse suspicious or irregular transactions.
RETENTION OF TITLE
3.8 Ownership of Products remains with Luxury of Homes Srl until full payment clearance.
EXPORT CONTROL AND SANCTIONS COMPLIANCE
3.9 Customers warrant compliance with applicable export control laws and sanctions regulations. Transactions involving restricted jurisdictions or persons may be refused.
PRODUCT AVAILABILITY
4.1 Orders remain subject to availability and supply conditions. Alternatives or refunds may be offered.
INVOICING
5.1 Invoices must be requested during checkout using accurate fiscal data.
DELIVERY AND RISK TRANSFER
6.1 Products are shipped directly from Producers or suppliers.
6.2 Delivery times are indicative and not binding.
6.3 Risk transfers to the Customer upon delivery to the carrier or at delivery as defined in the Order Confirmation.
6.4 Customers must inspect goods upon receipt and notify discrepancies promptly.
6.5 Import duties and customs charges remain the Customer’s responsibility.
IMPOSSIBILITY OF DELIVERY
6.6 Failure to complete delivery for causes not attributable to the Seller may result in contract termination and refund excluding incurred logistics costs.
WARRANTY
7.1 Products are covered by applicable legal warranty where required by law.
7.2 Additional warranties are provided by Producers where applicable.
7.3 Warranty excludes misuse, modification or improper installation.
RIGHT OF WITHDRAWAL
8.1 Withdrawal rights apply only where legally permitted.
8.2 Custom-made or made-to-order products may be excluded.
8.3 Returns must comply with formal written procedure and integrity conditions.
LIMITATION OF LIABILITY
9.1 The Seller does not guarantee uninterrupted access to the Site.
9.2 Liability excludes indirect or consequential damages including lost profits.
9.3 Aggregate Seller liability shall not exceed order value.
PROFESSIONAL USE DISCLAIMER
9.4 Purchases for professional or commercial use may not benefit from consumer protections.
INTELLECTUAL PROPERTY
10.1 All Site content remains property of the Seller or licensors.
CYBERSECURITY
11.1 Unauthorized interference with the Site is prohibited.
THIRD-PARTY LINKS
12.1 The Seller bears no responsibility for external content.
COMMUNICATIONS
13.1 Electronic communications are deemed legally valid written communications.
ASSIGNMENT
14.1 The Seller may assign rights or obligations without restriction.
FORCE MAJEURE
15.1 Events beyond reasonable control relieve performance obligations.
MODIFICATIONS
16.1 Conditions may be updated at any time.
GOVERNING LAW
17.1 Italian law governs these Terms.
17.2 Consumer jurisdiction protections apply; otherwise the Court of Forlì holds jurisdiction.
DISPUTE RESOLUTION
18.1 Complaints may be submitted to info@luxuryofhomes.com.
18.2 EU consumers may use the Online Dispute Resolution platform for settlement.
