SHIPPING POLICY

All products sold on the website are covered by the Legal Warranty of Conformity defined by the articles 128-135 of the Consumer Code (“Legal Warranty”). The Legal Warranty is reserved to consumers.

In case of lack of conformity of the product towards the description on the website, the user has the right to receive repair or replacement of the product, without any additional costs, wherever this is possible related to the number of available samples and only in case the replacement is no excessively expensive for the seller in relation to the original price of the product without defect. As an alternative the user has right to terminate the agreement or to receive a price reduction.in accordance to following dispositions.

The Supplier/Producer is responsible towards the consumer for any conformity default on the product at the moment of delivery and of those signs that arise during the first two years after the delivery. The Supplier/Producer has to be informed about the conformity default within the warranty period and within two months after it has been discovered.

In absence of the proof of the contrary, it seems reasonable to think that the lack of conformity discovered within the first six months after the delivery was already existing, unless the lack of conformity can be related to the nature of the product. In order to have the right for Legal Warranty, Users will have to bring proof of when the product had been purchased and delivered.

In case of termination of the contract, Luxuryofhomes will refund the user of the paid amount, including delivery fees and other additional costs.

In case of reduced cost, Luxuryofhomes will refund the user of the reduced amount previously defined.

In any case, the user will be informed about the amount of the refund by e-mail and the amount will be transferred on the means of payment used by the client. The delivery method has to be defined by the user and Luxuryofhomes.

The Legal Warranty does not cover any items that were repaired, changed or somehow manipulated by the user. Additionally, the Warranty does not cover any breakdowns, malfunctions or imperfections caused accidentally by the client by improper use and/or any different use than those written in the technical documentation.

The conventional warranties of the purchased products are those given directly by the producer. Luxuryofhomes cannot be held liable for any breach of duties relied to the General Conditions in case the breach is caused by any accidental events and/or force majeure, including reasons such as natural disasters, terrorist acts, network malfunctions   and/or blackouts.

-Who can confirm the conformity of the products on the website and the real nature of the products?

The Producers and/or Suppliers of the products collected on the website are asked to declare the conformity of their products to the national and community legislation of Italy.

The product description on the website belongs to the suppliers who take full responsibility of the information given. Images and colours of the product showcased on the website may differ from the real ones because of the the systems and/or devices used to picture the product. Luxuryofhomes does not take any responsibility for the absence of correspondence between the purchased product and the one showcased on the website if this is dued to an incorrect description given by the Supplier/Producer as Luxuryofhomes could not ever know about with the use of reasonable diligence.

 

-Who has to pay the customs duties?

In this case the entire quotation will be developed automatically with respect to the data entered by the customer himself, in case of non-EU purchase, no taxes will be charged on the product(s) and consequently the final customer will be in charge of clearing the purchased product(s) by paying the customs duties present in his country of residence according to the applicable laws.





-What is the “sales document” and what does it include?

(The Client is asked to check all personal data and details of the e-mail with the “sales document” attached and to inform Luxuryofhomes in case of system errors.

The “sales document” is the Client’s acceptance of the purchase proposal. The price quotation, instead, does not represent any acceptance of the purchase proposal of the Client.

The e-mail with the “sales document” includes:

  • Number and date of the order
  • Product/s, pieces, price
  • Selected payment method
  • Shipping charges, taxes and any customs duties (on quote only)
  • Total amount dued

The Sales Document will be considered as a contractual offer of purchase towards Luxuryofhomes with all products included and considered individually.)
